Waste Removal Lambeth Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Lambeth provides waste removal and associated services to residential and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any waste collection or related service.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Company means Waste Removal Lambeth, the provider of waste removal and associated services.

Customer means the person, firm, company or organisation who requests the services from the Company, whether as an individual, business, landlord, tenant or agent.

Services means any waste collection, waste removal, bulky waste clearance, garden waste removal, office clearance, domestic rubbish removal, recycling collection, loading, transportation, disposal and any related services provided by the Company.

Booking means a confirmed request for Services accepted by the Company, whether made by telephone, email, online form or any other agreed method.

Waste means any rubbish, junk, debris, materials or items presented for collection by the Customer, excluding any prohibited or hazardous items as set out in these Terms and Conditions or under applicable law.

Site means the property, premises or location at which the Services are to be carried out.

2. Scope of Services

The Company provides waste removal and collection services, including but not limited to household waste clearance, commercial waste removal, one-off bulky item collection, garden waste removal and related loading and transportation services. The precise scope of work for each Booking will be as agreed between the Customer and the Company at the time of Booking, based on the information provided by the Customer regarding the type, quantity and location of the waste.

The Company reserves the right to refuse to provide Services if, upon arrival, the waste or the Site conditions differ significantly from the description provided at the time of Booking, or if providing the Services would be unsafe, unlawful or impracticable.

3. Booking Process

Customers may request a Booking by contacting the Company via telephone, email or any online booking facility provided by the Company. The Customer must provide accurate and complete information, including the type and approximate volume of waste, location details, access arrangements, any time constraints and any relevant information regarding parking or loading restrictions.

The Company may provide an estimated price based on the description supplied by the Customer. All estimates are subject to confirmation on arrival, once the operative has inspected the waste and Site. The Booking will only be deemed confirmed once the Company has accepted the request and communicated a confirmation to the Customer.

The Customer is responsible for ensuring that the contact details supplied are correct and that they are available to receive communications in relation to the Booking. The Company does not accept responsibility for delays or failed collections arising from incorrect or incomplete contact details or access information provided by the Customer.

4. Service Area and Access

The Company primarily operates within its designated waste collection service area, which includes Lambeth and surrounding districts, together with other nearby areas as may be determined by the Company from time to time. Availability of Services may vary according to location, access constraints and vehicle routing.

The Customer must ensure that the Site is accessible at the agreed time and that there is adequate space and safe access for the Companys vehicles and operatives. This includes providing necessary entry codes, gate keys, parking permissions and ensuring that any access routes are clear and safe. If the Company is unable to gain access or carry out the Services due to access issues, the Booking may be treated as a failed collection and additional charges may apply.

5. Customer Responsibilities

The Customer must:

Ensure that the waste to be collected is clearly identified and separated where necessary.

Provide accurate information about the type and quantity of waste and disclose any items that may be hazardous, heavy, awkward or require special handling.

Ensure that the waste is not contaminated with items that are prohibited or that require specialised disposal facilities.

Ensure that children, pets and unauthorised persons are kept away from the working area during the provision of the Services.

Obtain any consents, permits or authorisations that may be required for the Companys vehicles to park or load at the Site, including any parking suspension or local authority permissions, unless otherwise expressly agreed in writing.

The Customer warrants that they either own the waste or are authorised by the owner to arrange for its removal.

6. Payments and Charges

Unless otherwise agreed in writing, all Services must be paid for in full on completion of the work on the day of collection. The Company may accept payment by cash, bank transfer, card payment or other methods communicated to the Customer.

Charges are usually based on volume, weight, labour time, access difficulty, disposal charges and any additional factors reasonably incurred by the Company. The Company will provide a price or estimate prior to the commencement of the work, and this may be adjusted if the actual waste or Site conditions differ from the description provided at the time of Booking.

Where the Customer is a business or public organisation and a credit account has been agreed in writing, payment terms shall be as set out in the account agreement. In the absence of such agreement, payment is due within 14 days of the date of the invoice. The Company reserves the right to charge interest and recover reasonable costs for late payment.

7. Cancellations and Amendments

The Customer may cancel or amend a Booking by giving the Company reasonable notice in advance of the scheduled collection time. Where at least 24 hours notice is provided, no cancellation fee will normally apply.

Where less than 24 hours notice is provided, or where the Company attends the Site and is unable to carry out the Services due to reasons within the Customers control, the Company may charge a cancellation or call-out fee to cover wasted time, travel and administrative costs.

If the Customer wishes to amend a Booking, for example by increasing the volume of waste or changing the collection time, the Company will use reasonable endeavours to accommodate the request but cannot guarantee availability. Additional charges may apply for any increased scope of work or rescheduling.

The Company reserves the right to cancel or reschedule a Booking in the event of vehicle breakdown, staff illness, adverse weather, traffic disruptions, safety concerns, regulatory issues or other circumstances beyond its reasonable control. In such cases, the Company will notify the Customer as soon as reasonably practicable and will offer an alternative collection time where possible. The Company will not be liable for any consequential losses arising from such cancellation or rescheduling.

8. Waste Types and Prohibited Items

The Company will collect general household and commercial waste, bulky items, furniture, appliances, non-hazardous construction and garden waste, subject to applicable laws and facility availability. Waste will be sorted and transferred for disposal or recycling in accordance with the Companys environmental policies.

The Company does not normally collect certain types of hazardous or specialist waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, liquids, gas bottles, pressurised containers, explosives, radioactive materials, oil, fuel, paint in liquid form and any items classed as hazardous under UK law unless expressly agreed in advance in writing.

If prohibited, hazardous or unsafe items are found within the waste at the time of collection, the Company may refuse to remove such items, adjust the quoted price or decline to complete the Services, and may charge for any additional handling, segregation or disposal that is legally required.

9. Compliance with Waste Regulations

The Company operates in accordance with relevant UK waste management legislation and regulations. All waste collected will be transported and disposed of using licensed facilities, and the Company will take reasonable steps to maximise recycling and recovery where practicable.

Where applicable, the Company or a partnering waste carrier will hold relevant registrations or licences required to transport controlled waste. Upon request, the Company will provide basic evidence of registration or disposal, such as a waste transfer note, where such documentation is appropriate for the type of waste and the nature of the transaction.

The Customer agrees not to request the Company to carry out any activity that would breach UK environmental or waste management regulations. The Customer is responsible for ensuring that any information they provide regarding waste composition is accurate, so that the Company can comply with applicable laws and duty of care obligations.

10. Liability and Limitations

The Company will use reasonable care and skill in providing the Services. However, the Companys liability to the Customer in respect of any loss or damage arising out of or in connection with the Services shall be limited as set out in this clause.

The Company will not be liable for any pre-existing damage to property, fixtures, fittings, grounds or items arising from the condition of the Site or the waste. The Customer is encouraged to highlight any fragile areas, delicate surfaces or concerns prior to the commencement of the Services.

Except in respect of death or personal injury caused by the Companys negligence, fraud or any other liability that cannot be excluded or limited by law, the Companys total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific Booking to which the claim relates.

The Company shall not be liable for any indirect, special or consequential loss, loss of profit, loss of business, loss of opportunity, loss of data or any similar losses, whether foreseeable or not, arising out of or in connection with the Services, delays, cancellations or failure to perform its obligations under these Terms and Conditions.

11. Damage to Property

The Company will take reasonable care to avoid damage to driveways, gardens, walls, paving and other property while carrying out the Services. However, the Customer acknowledges that heavy vehicles and the handling of bulky waste can pose risks, particularly where access is tight, surfaces are uneven or the Customer instructs the Company to proceed despite potential risks being identified.

If the Customer requests the Company to drive or operate vehicles on driveways, pavements, grassed areas or other non-standard access routes, this is done at the Customers risk. The Company shall not be liable for damage to such areas unless caused by proven negligence.

12. Customer Property and Valuables

The Customer must ensure that no items intended to be retained are mixed with the waste presented for collection. The Company does not accept responsibility for the loss of items that the Customer has placed with waste or has asked to be removed.

Once items have been removed and loaded onto the Companys vehicle, they will be treated as waste and cannot usually be retrieved. It is the Customers responsibility to check and confirm which items are to be removed before the Services commence.

13. Insurance

The Company will maintain appropriate insurance cover in respect of its legal liabilities while providing the Services. Details of insurance cover may be made available to the Customer upon reasonable request.

14. Data Protection and Privacy

The Company may collect and process personal information from the Customer for the purpose of managing Bookings, providing Services, processing payments and handling queries or complaints. The Company will handle such data in accordance with applicable data protection laws in the United Kingdom.

The Customer consents to the Company using their contact details to communicate regarding Bookings and, where permitted by law, to provide information about related services. The Customer may request that their details are updated or that certain communications are discontinued by contacting the Company.

15. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as practicable so that the Company has an opportunity to investigate and, where appropriate, remedy the issue. Complaints should be raised within a reasonable time frame following completion of the Services and should include details of the Booking, the Site and the nature of the concern.

16. Changes to these Terms and Conditions

The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to Bookings made after the revised Terms and Conditions have been communicated or made available. It is the Customers responsibility to review the current Terms and Conditions at the time of Booking.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

By proceeding with a Booking and using the waste removal services of Waste Removal Lambeth, the Customer acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
